1. The general terms of use on the site Eltick:

1.1. All the terms of use Eltick booking, billing airfare, hotel & other services that Eltick offers on the website Eltickare provided and updated by the staff of Eltick.

1.2. All the staff of affiliated websites Eltick belong to EL TICK PTY LTD with headquarters located in Perth, Western Australia. Details of Eltick are in the "Contacts" section of Eltick.

  • d) The phrase “Providers” in terms of use, is the one who directly supply service to the customers such as airlines, hotels, resorts, or other but Eltick.

1.4 Role of Eltick in service contracts:
1.4.1 Eltick provides airline tickets and cheap airfares to passengers as am agency accredited by International Air Transport Association (IATA) for the traditional airlines and affiliated managed by IATA (BSP Airlines). As for the low-cost carrier (LCC) and the airlines are not under the control of IATA (non-BSP Airlines), Eltick provides airline tickets and cheap airfares through contracts signed directly with LCC.
1.4.2 Eltick provides hotel service (rental rooms) to passengers as a travel agency. Eltick is not a representation, owned, management, operating, or guaranty of any rooms, hotels, or other services in Eltick’s website or linked website.

1.5 Eltick is responsible on behalf of the airlines which sign contracts with transported passengers as a accredited first agency of IATA.

1.6. Eltick is not responsible for service quality from Providers (exp: aircraft quality, room standard, service quality and customer care attitude, the safety of providers)

1.7. Eltick team perform their responsibilities to support under the terms of use by telephone, email, sms, fax, mail and in person at the office working hours framework of Eltick. Framework hours may vary by the actual situation, without notice and will be updated on the website Eltick. Eltick cannot handle the requirements of passengers during the holidays scheduled by the Government. Detailed information will be updated on the website Eltick.

1.8 Service’s fare on site Eltick include fares from the providers, the tax fees (airport tax fees, admin fees or hotel’s service fees, ect) and service changes of Eltick. The types of additional services which are not included in the price will be paid more by customers (not mandatory) . All charges combined are called "total price". Eltick is responsible to notify passengers the "Total Price" before proceeding with payment and booking complete.
Please note that the types of extra fees which are not included in the price will be paid more by customers and beyond Eltick’s control. They include: a resort fee, energy surcharge, baggage handling fees, the cost of delivery of newspapers, in-room security costs, travel/tour fees, or the cost for cleaning the rooms under extraordinary circumstances, etc …

1.9. Service charges are set based on each detailed booking such as itinerary, destination, number of passengers or nights and the region and to be informed in detail when booking. Fees are not refundable for passengers under all circumstances after booking complete.

2. The general conditions of use of electronic services:

2.1. Passengers must accept the general terms of use when visiting the site Eltick and other services provided by Eltick. The terms used are updated on the site Eltick.

2.2. Reservations (Booking): the user visits Eltick or through the staff support of Eltick to buy service provided by Eltick (airline tickets, bookings hotel and other services). Users are entitled to make the requests such as the departure date, return date, destination, number of passengers, number of registered baggage, meals, check in and check out, travel insurance, budget, etc ...

2.3. Request booking unconfirmed immediately (Order): are the users who visit the site Eltick or through staff support of Eltick to buy service: provided by Eltick. Order can be successful with total price announced and seats confirmed immediately. Order cannot succeed with total price and booking status not verified. In case the Order failed, Eltick staff will contact the user within 30 minutes after completion of the Order (during working hours of Eltick) and implementation consulting itineraries or hotels.

2.4. Immediate payment (Express Purchase) are the users who visit the site Eltick or through staff support of Eltick to complete payment by the payment method and secure diversity of Eltick. Express Purchase are encouraged to buy service under 24hrs before using or limiting the number of seats or rooms. Staff supporters will inform users about the types of services for users to conduct appropriate Express Purchase.

2.5. All provisions concerning Booking, Purchase Order and Express are updated on the site Eltick.

2.6. Users should carefully read and accept the terms related to the Booking, Purchase Order and Express before making payments.

2.7. The Providers on side Eltick have their own services regulation that is not managed by Eltick such as terms and conditions of the airlines, commercial policy of hotels, ect, … Users agree to purchase with Providers synonymously accept the conditions of them.

2.8. The contents of the website are protected by Eltick law and prohibits the forms of reproduced or quoted materials without indicating the source.

2.9. To implement and complete the Booking, Purchase Order and Express, the user should have an electronic mailbox (email) or mobile phone number is active. When providing contact information, users agree to allow Eltick to contact via the provided information.

2.10. The users provide personal information to complete the Booking, Purchase Order and Express means that they allow Eltick's use within the process of Booking, Order and Express Purchase and the related feedback for Booking, Order and Express Purchase.

2.11. Trade names, commercial images, import brand commercial patio of Eltick are protected by law. The user shouldnot violate property rights, brainpower, copyright materials from Eltick.

2.12. Eltick may provide personal data to government agencies authorized for activities contrary to the law.

3. Immunity from liability:

3.1. Information of passenger on Booking:
Passengers on flights should have a valid service for travel by air aviation law and domestic immigration law. To achieve this, passengers should provide information such as user identity papers, a valid visa at the time of Booking, Purchase Order and Express. In cases where passengers buy the special tickets (eg ticket for students, sailors, laborers, etc ...), passengers should present their vouchers are allowed to buy all kinds of these ticket.
Passengers on booking hotel should have a valid document to check in at the hotels.

3.2. Eltick is not responsible if the passenger fails to comply with section 3.1 after completing Booking, Purchase Order and Express.

3.3. Eltick is not responsible in case Booking, Purchase Order and Express did not succeed because of technical reasons (the error of the link system), increasing price or the majeure cases.
Noted: In some cases, Eltick may consider and decide to cancel or deny a booking due to the wrong price, incorrect hotel’s name, wrong check in – check out date, provide of hotels, ect. Eltick will refund total price to the customers.

3.4. After completing Booking, Purchase Order and Express, the airline will be solely responsible for the following cases:

  • a) Any delay or any changes to details booking by the Provider announced (eg: flight stastus, check in time change, etc).
  • b) Quality of service, amenities, rating information and other services of the providers (e.g lost luggage, require special support of the airline, etc).
  • c) Passengers absent, do not use service on Booking or break the rule of the providers (itinerary of flight, date check in aviation regulations, ect).
  • d) Passengers who bought services but did not use all the services (for example, buying a return ticket but use only one-way, arrive after checking in date, leave before checking out date, etc ...).
  • e) Passengers who are denied using the service due to disobeying regulations mentioned in paragraph 3.1.

3.5. The complaint related to breach of service contract between passenger and the providers will be taken by passengers according to the current regulations of the providers.

3.6. Eltick is not responsible if the cause was determined to be cases of force majeure or faults entirely caused by the provides

3.7. Eltick is not responsible for the choice of service or Provider on Eltick’s side. In all cases, any compensation fee equal to the fee that was paid to passengers in the process of completing Eltick's Booking, Purchase Order and Express.

3.8. It is the responsibility of passenger to check and ensure legal documents to travel.

4. Make a booking on Eltick:

4.1. Users perform booking process on Eltick through the operators of Eltick or buy directly at the office of Eltick.

4.2. The user agrees to the terms of Eltick from time to access the site Eltick.

4.3. Users are asked to provide data to complete Eltick's Booking, Purchase Order and Express include:

  • a) Their full names on identity papers, emails and telephone numbers...In case users buy tickets or booking for other people on the flight / hotel, that user needs to provide information of passengers making a flight or staying at hotel including their full names on their personal papers, phone number and email contact, ...
  • b) Requirements for additional services or special assistance.

4.4. Booking, Purchase Order and Express cannot be done if the user provides information that lacks one of 4 terms in section 4.3.

4.5. To perform Booking, Purchase Order and Express, in addition to the information in Section 4.3, users are asked to provide additional data including:

4.5.1 Airline tickets:

  • a) Departures and arrivals
  • b) Date of departure and date of return (for a roundtrip ticket)
  • c) The number of people flying, including adults (18-60 years old), the elderly (over 60 years), children (2-12 years) and infants (0-2 years old).
  • d) Request nonstop flights or transit.
  • e) The flexibility in choosing the date of departure and date of return.

4.5.2 Hotel bookings:

  • a) Arrivals or the hotel’s name.
  • b) Date of check in and date of check out.
  • c) The number of people staying, including adults (from 12 years), children (2-12 years) and infants (0-2 years old).
  • d) Request add on services.
  • e) The flexibility in choosing the date of check in and the date of check out.

4.6. The user needs to ensure the accuracy of the information provided under Section 4.3 and 4.5. Additionally, the user should pay special attention to the General fares and detailed in Section 1.8. The total price may change at any time until the date of payment and booking complete.

4.7. Eltick will notify users purchasing time limit or change terms of providers by email, sms, phone or in person at the office.

4.8. Eltick will not be liable if there is a change from the total price due to original prices rose, a system error is not connected, the status change reservations, purchasing time limit change from Providers or by Eltick cannot contact people with reservations according to information provided. The user can accept the following options:

  • a) Accepting payments with a more different amount of fare and a new purchasing time limit.
  • b) Taking back the entire amount paid to Eltick if users decide to cancel the Booking through bank account information that passengers provide or receive cash at the office of Eltick.
  • c) Reserved amount paid in Eltick to buy new service (eg new itinerary or new hotel) that best fits the criteria of passenger.

4.9. Users bear full responsibility if providing inaccurate information in proposed in section 4.3 and 4.5. After completing Booking or Order, users wishing to change information they should notify via email, sms to the hotline, telephone or directly at the office. In this case, Vivaviviu.com does not guarantee confirmation of booking status, itinerary selected earlier and total price as in the beginning. Eltick is obliged to inform the user if there are any changes that occur and will not be responsible for the change by the user.

4.10. The users accept the website interface for the advertising, marketing, and promotion.

4.11. Information on the Booking or after completion will be notified to users through email, sms, phone or in person at the office with the information include:

  • a) Eltick code.
  • b) Deadline to reserve (the payment date).
  • c) Total price include fares, taxes and charges service fees.
  • d) Detailed itinerary.
  • e) Detailed passenger information provided by users.
  • f) The method of payment. If passengers choose the mode of payment by credit card, passengers or the user must provide credit card details including the cardholder's name, card number, CVV or 3D code by issuing banks provide.
  • g) Other information relating to servicefares or regulation of providers.

4.12. By making payments for Booking or Order, the user agrees to the terms of use, undrstands and accepts the provisions of Eltick well as the airlines.

4.13. Booking/Order is not the paid booking. Passengers must use the electronic voucher (ID booking) for check in. Eltick will offer electronic vouchers via email, sms or directly at the office paper Eltick after receiving advance payments.

4.14. Total prices are as Section 1.8 is calculated in Australia Dollar (AUD) and have included value added tax.

4.15. Regardless of the delay in the payment process or Express Purchase from the user's side can also lead to a situation which Booking, Order cannot be done.

4.16. The payment of part of the Total price synonymous with unpaid booking.

5. General Provisions on payment:

5.1. Users can pay by one of the payment methods notified from Eltick under Section 4:11. Note, Eltick does not guarantee that all of the payment methods will be applied equally to the Order /Booking Payment methods can also depend on the nature of the different airlines and current policy on Eltick.

5.2. Users agree that the payment date will be the date of receipt of complete Eltick total price, has been notified by email, sms, phone or in person at the office. Total price can pay by the methods notified by email, sms, directly at the office or by phone. In addition, payment methods are also posted under "Payment" on the site Eltick. Payments can only be processed in the working hours of Eltick. Working hours of Eltick are posted on the website Eltick.

5.3. Users note that total price cannot be guaranteed not to change until receiving payment and booking completed.

This provision does not apply to the amount that was paid users to perform Booking or before the time of cancellation Booking/ Order. Users will get back the amount you have to pay according to the method in Section 4.8.

6. Payment by credit card

6.1. Users agree that credit card payments can be made through the following methods:

  • a) Payment through Galileo system or Wordspan
  • b) Direct payments to hotels.
  • c) Payment via bank payment gateway.
  • d) Payment via imprint machines issued by banks.
  • e) Payment via convenient store.
  • f) Other payment methods that are regularly offered & updated.

6.2. Users are responsible for the payment of their credit card in accordance with the conditions under which users have signed with the credit card issuer. Eltick is not be liable in any form of the use of credit card of the users. Users are responsible for the reliability of the information on a credit card that users update to the form of payment by credit card to buy airline tickets. By using a credit card for payment, users ensure that they are the owner of the credit card or the credit card owner has agreed for users allowed to use this. Eltick may require users complete a credit card statement to determine the identity of the cardholder before approving the payment by credit card. In this case, users need to complete the credit card statement and return it before the deadline of Booking/Order. If users do not complete the declaration on time, or Order/Booking may not be realized. In case of doubt about the accuracy of your credit card information or the identity of the cardholder, Eltick may refuse payment by credit card and report back immediately to the user.

6.3. Specifically, users agree to make the payment by credit card, users must provide the following information for Eltick:

  • a) Full name of the credit card holders
  • b) Type of credit card
  • c) Credit card
  • d) Time expired card
  • e) The code CVV2 / CVC2 (last three digits in the back of the credit card)
  • f) Other information that may be required by payment gateways.

6.4. Users agree that providing the above information in your credit card for Eltick not mean that card issuers will agree to the users perform this payment. Eltick has no responsibility in case the payment is denied and will immediately notify users when the payment was refused. In this case, users can select the form of payment.

6.5. Users agree that the payment by credit card, the credit card account of the user who will be collecting a sum equivalent to the total fare paid for Eltick and credit card payment fees (if applicable).

6.6. By providing the information as indicated in Section 6.3 above, users agree to use credit cards to pay an amount equivalent to the total fare for Eltick and credit card payment fees.

6.7. The authentic credit card only processed during working hours of Eltick which have been posted on the website Eltick. In case users make payments Booking/ Order by credit card or directly in the office or over the phone with a staff of Eltick, tickets will be made. In case the card was declined, Eltick will immediately notify users.

6.8. Eltick will immediately contact users in the following cases:

  • a) Lack of information to authenticate credit card of users.
  • b) In the case of payment by credit card is not done, users can select the form of payment or cancellation. Users are solely responsible for the risks related to the credit card was declined.
  • c) Accept payment by credit card is a form of payment for Booking or Order. However, Eltick insists that this does not ensure that the total fare will not change. Airlines can completely change the total fare after the user has agreed to make the payment by credit card. If there is a change in fare for the period from after the time of the credit card payment was made until before tickets issued, users have the right to decide in accordance with section 4.8.

7. Payment of bank transfer:

Users can use bank transfer to pay if this form of payment is accepted in the Booking confirmation or Order. When paying by bank transfer, users will get the confirmation from the bank for the transfer. Confirmation from the bank does not mean Eltick received money and no means contract of carriage has been concluded.

8. Cash at the offices:

Users can pay by cash at the office of Eltick. Users also can pay by direct deposit cash in the bank account which Eltick. In the case of use of banking services, users may have to pay transaction fees under the provisions of each bank. 9. Payment by electronic payment gateway Nganluong.vn:

9.1. The users can use the form of electronic payment gateway. In the confirmed reservations, with a link to the site so users can make the payment by electronic payment gateway. To access this site, users should follow the instructions in the Booking or Order.

9.2. After accessing the site, users must abide by the rules, notices and guidelines of websites.

9.3. Eltick is not responsible for the work related to the payment by electronic bank. The e-wallet payment by bank amount comply with the contract. Eltick is not responsible for any errors related to the electronic payment, including the errors occur because users provided inaccurate information when make payments.

9.4. After making payment by electronic bank for the amount, users will receive a confirmation of successful payment. Within maximum 1 hour after making the payment, if users do not receive confirmation of the successful payment, users need to contact the bank and Eltick (during office hours Eltick to find a solution.

9.5. The time for which the payment was successful is time that Eltick has received confirmation of users paid from Bank quantity.

10. Cancellation of Booking:

10.1 Cancellation from the Providers:
The users accept that providers may cancel after booking completed for some subjective reasons from providers or for reasons of force majeure. Providers are solely responsible for the cancellation of service. In the event receives information about the cancellation from the providers, Eltick will immediately notify users as well as the solution suggested by the providers.

10.2 Users have the right to cancel in accordance with the conditions that users ended contract of Providers with. Eltick is obliged to inform the user of this condition at the time of Booking, Order, Express Purchase, payment and booking completed.

10.3. Under any circumstance of cancellation, the service fee that users were paying for Eltick will not be refunded.

10.4. To cancel, users contact Eltick telephone, email or in person at the office.

10.5. Under any circumstance of cancellation, users that book via any partner of Eltick will have to pay rack service rate equal the refund fee of Eltick.
Refund fee of Eltick:
- Domestic route: 30 AUD/ person.
- Others: 50 AUD/ person

10.6. All refunds will be cash back via the original way. There is an exception that the payment via Zalopay is over six months from the transaction date. Eltick will process the refund via bank transfer, cash at our Saigon office or by Paypal. All payment fees include exchange rate and transaction fee from Paypal will be charged by the passengers.

11. Change of Booking:

11.1 Changing completed booking:
Users agree that the providers can change the parameters of the service (eg Change departure time, transit time, port aircraft, promotional of hotels, etc ...) after booking completed have been made. For some reason subjectivity from providers or for reasons of force majeure, providers are solely responsible for the changes. In the event receives information about the cancellation from the provider, Eltick will immediately notify users as well as the solution is suggested by the providers.
Please note that the users should check providers’ policy carefully.

11.2 Changing the name of passengers.
Usually, services do not allow the renaming of passengers. In some special cases, if the airline or the hotel allows passengers to rename then Eltick will perform the name change at the request of users for a fee change (if any) and service charges of Eltick be notified by telephone, email or in person at the office Eltick.

11.3. The users have a right to changing the booking (date change, check in date change, route change…) and must be follow the regulation of the providers. Eltick is obliged to inform the user of this condition at the time of Booking, Order, Express Purchase, payment and booking completed.

12. Member Register:

12.1. Users can sign up to become a member of the site is completely free on Eltick.

12.2. For account access, users must register.

12.3. Users register by completing the registration form on the website of Eltick.

12.4. With some required fields, the register process is only be realized if the required fields are full of information.

12.5. Users can use this account to perform Booking, Order and Express Purchase and use other services provided by Eltick.

12.6. After receiving the member registration from users, Eltick will send a confirmation register with the account name, password (User / Password) and a link to activate. 13.5. Eltick commits that the processing of personal data of users complies of domestic law of Vietnam and Eltick will use technical solutions necessary to ensure personal information is not being unauthorizedly access.

13.6. Eltick confirmed not handle the personal information that users provide to the payment system.

13.7. The user can proceed to implement any changes in the scope of their personal information by sending a written request for information "Contact" section posted on the website Eltick.

14. Complaints:

14.1. The users have the right to complain about the services provided by Eltick.

14.2. The contents of user complaints should have:
